The US Department of Justice is expected to recommend that marijuana be rescheduled as a Schedule III controlled substance, a classification shared by prescription drugs such as ketamine and Tylenol with codeine. The standard rulemaking process is lengthy, is subject to a public comment period, and could take months to complete. However, rescheduling marijuana will not solve that federal-state conflict, the Congressional Research Service noted in a January 16 brief. States with medical marijuana programs do currently have some federal protections in place via appropriations legislation that restricts the Justice Department from interfering in those programs. The FDA’s scientific and medical evaluation of marijuana did not address products containing plant-derived cannabidiol, commonly known as CBD.

On Thursday, the Supreme Court gathered to consider whether Donald Trump, as president, enjoyed immunity from prosecution for attempting to overturn the 2020 election. Even if the justices eventually rule against him, liberals should not celebrate the Constitution as our best bulwark against Mr. Trump. Each of these efforts has been motivated by a worthy desire to hold Mr. Trump accountable for his actions. It is not just that Mr. Trump would never have been president without the Electoral College. Think about why those previous efforts to use the Constitution to hold Mr. Trump accountable failed.

CNN —The bird flu spreading through cattle in the United States is an “enormous concern” the chief scientist of the World Health Organization said Thursday as he called for more tracking and preparation for the virus. So far, there is no evidence that the highly pathogenic H5N1 flu virus can spread from person to person. Though H5N1 doesn’t spread from person to person, humans can catch it when they’re exposed to infected animals. They are only the second documented case of human H5N1 in the United States. The US Centers for Disease Control and Prevention says that while the current risk to public health from H5N1 is low, it is monitoring the situation carefully.

Given the impact of Covid, it is deeply disappointing that national governments are not investing the necessary resources to build life-saving pandemic preparedness capacity. Making matters worse, Congress has made major cuts to pandemic preparedness funding, as part of the ongoing appropriations process. Playing the long game also means supporting the World Bank Pandemic Fund, which is designed to invest in long-term pandemic preparedness capacity of low- and middle-income countries.

Now, the Supreme Court will consider whether the prosecutors’ interpretation of the law can be used against the rioters and whether the convictions already secured will stick. The charge at issue in the Supreme Court case stems from a law Congress enacted in response to a series of corporate accounting scandals, including the 2001 Enron debacle. The case before the Supreme Court involves only that last charge. All three defendants appealed to the Supreme Court, but the justices granted only Fischer’s case.
